Privacy statement FastMicro B.V.

This privacy statement explains what personal data is, which data FastMicro processes, for what purpose and the way in which this is done. It also explains the data subjects’ rights and how to these can be exercised.

What is personal data?

Personal data means all information about an identified or identifiable natural person, such as contact details, curricula vitae (‘CV’) and online identifiers. Sensitive personal data include, for example, data on racial or ethnic origin, criminal record, religious or philosophical beliefs, trade union membership and information concerning the state of health or sexual behavior.

Which data does FastMicro process and for what purpose?

FastMicro processes personal data for various purposes.
FastMicro processes special personal data for limited purposes.

When does FastMicro share personal data?

Sharing within FastMicro
FastMicro only shares personal data within the FastMicro with employees authorized to access this data. All employees are subject to confidentiality.

Sharing with clients
FastMicro will only share personal data with clients for the legitimate interest of the business. This data will only pertain contact information.

Sharing with processors
FastMicro uses processors that process personal data for FastMicro. FastMicro concludes processing agreements with all processors of personal data.

Sharing with other responsible parties
FastMicro works with external parties that offer services, whereby personal data can be exchanged. These are, for example, parties carrying out screening, providing training or booking flights and/or hotels. FastMicro makes arrangements with these parties with regard to the careful handling of personal data.

FastMicro only discloses personal data at the request of the police and the authorities if there is a legal obligation to do so. FastMicro does not transfer personal data outside the European Economic Area (EEA).

How long does FastMicro retain personal data?

FastMicro does not retain personal data for longer than is necessary for the fulfilment of its purposes. In some cases, FastMicro is obliged to retain personal data for a longer period of time, for example because of tax obligations. After expiration of the retention period, or following successful deletion requests from data subjects, FastMicro deletes the personal data from its systems.

What rights do data subjects have?

FastMicro respects the rights of data subjects with regard to their personal data. Some rights can be exercised at all times; other rights can be exercised under certain conditions only.
For example, FastMicro cannot grant the request of a data subject to delete its personal data if there is a legal obligation to retain that personal data for a certain period of time, or is required to fulfill a contract with the data subject.

Data subjects can exercise the following rights:
Withdrawal of consent given for processing personal data;
Access to personal data;
Correction of inaccurate personal data;
Deletion of personal data if FastMicro no longer needs it;
Objection to the processing of personal data on the basis of a legitimate interest of FastMicro or another controller, if data subjects have major interests for making such an objection;
Restriction on the processing of personal data in cases determined by law;
Data transfer of own personal data provided to FastMicro in cases determined by law;
Lodging complaint with the national supervisory authority about the processing of personal data by FastMicro.

The aforementioned rights can only be exercised in respect of the personal data of the data subject. Data subjects are not allowed to exercise these rights in respect of the personal data of others. FastMicro may request data subjects to provide additional identification .

How does FastMicro protect personal data?

FastMicro takes appropriate technical and organizational measures to protect the privacy of the data subjects and the confidentiality of their personal data.

FastMicro’s infrastructure is scanned for viruses, malicious software and break-in attempts. FastMicro arranges for regular checks on its infrastructure and security processes. FastMicro’s data is kept isolated from the other companies it shares certain resources with.

FastMicro has also ensured that not everyone within the organization has access to personal data. Access is restricted to FastMicro employees for whom the processing of personal data is necessary in the performance of their duties, such as HR or payroll.

Amendments to Privacy Statement

FastMicro is entitled to amend this privacy statement. Changes will be published on the website. This privacy statement was last updated on 25 August 2020.

Overview of the purposes of processing and the types of personal data processed

In the context of job applications to FastMicro

Purpose of processing:
• To assess CVs or professional social media profiles at the request of data subjects.

Personal data processed:
• Personal data: First name; surname; date of birth, place of birth
• Contact Details: address; email address; telephone number
• curriculum vitae

Personal data processing actions:
• To determine the validity and suitability of the data subject for FastMicro
• To select candidates for positions within FastMicro
• To contact candidates for positions within FastMicro

Data retainment period:
• Personal data will be removed within 30 days of final contact with the data subject. Data required for the legitimate interest of FastMicro will not be removed. If the data subject has given consent for extended processing, FastMicro reserves the right to keep their data until the data subject requests removal or withdraws their consent. At this point, FastMicro will comply within 30 days.

Events , newsletters, visiting and training

Purpose of processing:
• To organize events, visits and activities to encourage the involvement in FastMicro of candidates, employees, representatives and business relationships of FastMicro; To exchange non-personal information, such as knowledge and interesting topics with data subjects.

Personal data processed:
• contact details; dietary restrictions; location and transportation options

Personal data processing actions:
• Personal data is stored and used to contact data subjects regarding events; plan events and/or sending newsletters.

Data retainment period:
• All data will be removed within 30 days after the data subject ends the contract or business relationship. Any data still required for alternative purposes will remain available.

Employment agreements or contracts for services

Purpose of processing:
• Registering personal data required for compliance with laws and regulations;
• Perform employment contracts

Personal data processed:
• Legal requirements: Identity documents or passports; visas; work permits; citizen service numbers; contact details; diplomas.
• Screening data: Certificate of good conduct; references; declarations of integrity and confidentiality; secondary functions.
• Financial information: Bank account numbers; salary; rates (external services)

Personal data processing actions:
• Personal data will be shared with data processers to pay salary and pay the required tax.

Data retainment period:
• All data not legally required to be kept will be removed within 6 months of contract end.

Client relations

Purpose of processing:
• Acquiring and retaining contact details of new potential clients.
• Acquiring and retaining information regarding the sector they operate in and demand for labor.

Personal data processed:
• Contact details.

Personal data processing actions:
• Personal data can be used to contact relations in the sector FastMicro determines to be potential leads.
• Personal data can be used to contact relations to maintain a positive supplier-customer relationship.

Data retainment period:
• All personal data will be removed within 30 days of the data subject ending the business relation.

Supplier relations

Purpose of processing:
• Acquiring and retaining contact details of new potential suppliers.

Personal data processed:
• Contact details.

Personal data processing actions:
• Personal data can be used to contact suppliers to maintain a positive supplier-customer relationship.

Data retainment period:
• All personal data will be removed within 30 days of the data subject ending the business relation.

CCTV Monitoring, visitor logging

Purpose of processing:
• Providing additional safety and information regarding trespassing.

Personal data processed:
• Video footage of the FastMicro location and surrounding area, name and time of visit of visitors.

Personal data processing actions:
• Video footage is live, and previous footage be looked back through.

Data retainment period:
• Video and log of visitors will be removed 6 weeks after the recording. If misconduct, trespassing or other unlawful actions are visible, FastMicro will not remove the data.
